Mr. Musto's focus is representing individual and institutional trustees, executors and personal representatives, professional fiduciaries, and beneficiaries in trust and probate litigation. He specializes in matters involving breaches of fiduciary duty, financial elder abuse, trust and will contests, and the claims of pretermitted heirs.
Mr. Musto's fiduciary litigation capabilities include a wide range of matters, including claims of financial elder abuse; professional liability and fiduciary fraud; corporate governance issues, minority shareholder and derivative suits, and other management liability issues. He has special expertise in disputes involving general and limited partnerships, LLCs and LLPs, having successfully prosecuted and defended claims for breach of fiduciary duty, violation of the Corporations Code, and breach of controlling agreements. In addition, he has litigated bad faith/insurance coverage claims on behalf of policyholders, insurers and reinsurers.
Mr. Musto possesses a broad background in civil litigation in both trial and appellate courts. He is a seasoned civil litigator, with extensive trial experience, who has also briefed and argued several groundbreaking cases in the courts of appeal.
